Terms of Service

IMPORTANT NOTICE: This Agreement includes binding arbitration for disputes unless you opt out. See the “Dispute Resolution” section below.

This Terms of Service Agreement (“Agreement”) governs your use of the vpn.coffee website (“Site”) and our Virtual Private Network (“VPN”) services (“Services”) provided by VPN.Coffee (“we,” “us,” or “our”). By using the Site, purchasing a subscription, or using the Services, you (“you” or “Subscriber”) agree to this Agreement, our Privacy Policy, and other applicable policies (collectively, the “Agreements”).

Eligibility

You must be:

1. At least 18 years old,
2. A valid legal entity,
3. An emancipated minor, or
4. Have parental or guardian consent.
   If you’re 13–17, a parent or guardian must activate the Services. If under 13, you may not use the Site or Services.

Acceptance

By accessing the Site or Services, you agree to the Agreements. If you disagree, do not use the Site or Services.

Access Rights

We grant you a limited, revocable, non-transferable right to access and use the VPN Services for personal, non-commercial purposes, subject to this Agreement. The Services utilize third-party software, such as WireGuard, to facilitate connectivity to our VPN servers, as described in our documentation. All intellectual property in the Services and Site belongs to VPN.Coffee or its third-party providers, protected by:

• U.S. and international copyright laws,
• Patent laws,
• Trademark laws.
  You must not:

1. Copy, modify, distribute, or reverse engineer any part of the Services,
2. Remove copyright or trademark notices.
   This Agreement applies only to our VPN Services.

Changes to This Agreement

We may update this Agreement at our discretion:

• Material Changes: Notified 30 days in advance via email or Site.
• Non-Material Changes: Effective immediately upon posting.
  Continued use after changes means you accept them. Review this Agreement regularly. You must comply with U.S. laws.

Conduct

You must use the Services legally and not:

1. Send spam, chain letters, or illegal emails,
2. Access or share illegal content (e.g., child sexual abuse material),
3. Use copyrighted material without permission,
4. Forge content origins,
5. Disrupt others’ use (e.g., denial-of-service attacks),
6. Hack or probe systems without authorization,
7. Share harmful or defamatory content,
8. Violate U.S. or local laws,
9. Abuse Services (e.g., excessive bandwidth or reselling access).
   We may monitor usage and restrict accounts for abuse.

Export Controls

Services are subject to U.S. export laws, including:

• Export Administration Regulations (EAR),
• OFAC sanctions.
  You confirm you:

1. Are not sanctioned,
2. Are not in a sanctioned country (e.g., Cuba, Iran, North Korea, Syria),
3. Are not involved in prohibited activities (e.g., weapons proliferation),
4. Will not export Services illegally.

Breach

We have a zero-tolerance policy for breaches, which may lead to:

1. Warnings,
2. Account suspension without refund,
3. Termination,
4. Legal action,
5. Disclosure to law enforcement.
   Contact support@vpn.coffee if your account is suspended.

Indemnity

You agree to indemnify VPN.Coffee, its affiliates, and agents against claims, damages, or costs (including attorneys’ fees) from:

1. Your use of Services,
2. Breach of this Agreement,
3. Violation of third-party rights,
4. Harm caused by your use.
   This survives termination.

Service Level Agreement

We strive for high availability but don’t guarantee:

• Uninterrupted access,
• Specific speeds,
• Performance.
  Services may be unavailable due to:
• Maintenance,
• Emergencies,
• Network issues,
• Force majeure.
  We may limit, throttle, or suspend Services at our discretion. No guarantees on data delivery or accuracy.

Multiple Accounts

You may buy multiple accounts for personal use, possibly eligible for bulk discounts.

• Sub-account users must comply with this Agreement.

Client Responsibilities

You are responsible for:

1. Keeping your account confidential,
2. Providing accurate information,
3. All activity under your account.

Fees, Auto-Renewal & Cancellation

All payments are in USD. We accept credit cards, PayPal, cryptocurrency, and other methods at checkout. Subscriptions are processed via third-party processors.

• Payments are charged on signup and auto-renew unless canceled via your account dashboard.
• Once your VPN is activated and delivered, the transaction is complete, with refunds governed by our Money Back Guarantee policy.
  To Cancel:
• Disable auto-renewal in your dashboard.
• Cancellations within 7 days may qualify for a refund; otherwise, access continues until term end.
  Fee changes are notified 30 days in advance and apply to renewals. We’re not responsible for third-party pricing errors. Free trials (if offered) are for new users; cancel within 24 hours to avoid charges.

Refund Policy

Money Back Guarantee: Refunds are available within 7 days of purchase or renewal if unsatisfied.

• Once your VPN is activated and delivered, the transaction is complete, with refunds governed by our Money Back Guarantee policy.
• Requests after 7 days are denied.
• Provide verification within 7 days, or forfeit refund.
• No refunds for purchases within 3 months of a prior refund.
• For cryptocurrency payments, you bear all transaction fees (original and refund). Refunds require a wallet address and are valued in USD at disbursement.
  Third-party purchases (e.g., gift cards) follow their policies.

Our Rights

We may:

• Suspend or terminate accounts without notice,
• Throttle bandwidth for abuse,
• Cease operations with 30 days’ notice (no refunds).

Warranties

You confirm:

1. Your information is accurate,
2. You have authority to enter this Agreement.
   You agree to our Privacy Policy and DMCA policy.

Warranty Disclaimer

Services are provided “AS IS” without warranties, including:

• Merchantability,
• Fitness for a purpose,
• Non-infringement.
  We’re not liable for errors, viruses, interruptions, or third-party content. Use at your own risk.

Limitation of Liability

VPN.Coffee is not liable for indirect, incidental, special, or punitive damages, even if advised of the possibility. Our liability is limited to what you paid us in the last 3 months.

Dispute Resolution, Arbitration & Class Action Waiver

Arbitration: Disputes are resolved by AAA under Consumer Arbitration Rules, governed by the Federal Arbitration Act. Hearings are in Kings County, NY, unless agreed otherwise. The arbitrator’s award is final.
Informal Resolution: Before arbitration, send a dispute notice to support@vpn.coffee with your name, email, and relief sought. A 60-day resolution period applies.
Class Action Waiver: Disputes are individual only; no class or consolidated actions.
Non-Arbitrated Claims:

1. Small claims court,
2. Intellectual property disputes,
3. Injunctive relief.
   Opt-Out: Email support@vpn.coffee with “ARBITRATION OPT-OUT” within 30 days of first use, including your name and email.

Assignment

You may not assign this Agreement. We may assign without restriction.

Severance

If a provision is invalid, the rest remains enforceable.

Choice of Law

Governed by New York law, without conflicts principles. Exclusive jurisdiction in Kings County, NY courts. You consent to service there.
